3. What is not included
No tier includes use of the beat or the Song in film, television, advertising, games or other sync use. Those need a sync licence for the beat. Radio airplay is allowed on the Unlimited and Exclusive tiers only.
4. Ownership and publishing
ZAWA keeps ownership of the beat and the master recording of the beat. You own your lyrics, vocals and other original parts you add, subject to ZAWA's share of the composition.
Unless a signed agreement says otherwise, ZAWA keeps 50 per cent of the writer's share and 100 per cent of the publisher's share of the Song. You register the Song with your performing rights organization and mechanical society and list ZAWA's interest as agreed. For the Unlimited tier the split is agreed in writing before release.
5. Credit
Credit the beat as your certificate shows, for example "Produced by Joshua Zawa / ZAWA Music Inc", in the title or description of the release, on streaming credits where the service allows, and in the metadata.
6. Content ID and claims
You may not register the beat or the Song in Content ID or any fingerprinting system. Some of our beats are on streaming services, so a platform may flag your Song by mistake. Send your licence ID and we will ask for the claim to be released. See Content ID and claims.
7. Passing your limit
If your Song passes a limit of your tier, tell us and upgrade to the next tier within 14 days. If you do not, we may treat it as a breach under the Terms of Sale.
8. Non-exclusive means non-exclusive
Other people may hold licences for the same beat. We do not promise that no one else will release a song on it. Tracks that ZAWA has already released on streaming services stay available.
9. Stems and files
Stems and WAV files are for your own recording, mixing and release. They may not be shared, sold or put in a library or marketplace.
10. Exclusive and buy-out
An Exclusive licence is made on a separate signed agreement. It removes the beat from sale, keeps earlier non-exclusive licences valid, and sets credit, publishing and any reversion. Ownership of the beat does not pass to you under a standard exclusive.
11. Other terms
The Terms of Sale apply to this licence, including limits on liability, indemnity, breach and termination, governing law and the rules on what is never allowed.
